TERMS and CONDITIONS
I am an independent travel agency and I like to think I am anything less than ordinary. Priding myself on the service I provide to my customers I like to make sure that your journey whether its near or far will be one that’s unforgettable based on both the experience you receive from me and your destination.
INTERPRETATION
-
Except where the context otherwise dictates the following words and phrases bear the following meanings:

“the client”: the person listed in a booking form | “force majeure event”: an event beyond the Tour Operator’s control which in terms of the common law excuses non-performance or delayed or reduced performance by the Tour Operator

“tour”: a tour, day-trip, safari or combination of them, described singularly or in combination in the Tour Operator’s brochure

Headings herein are for guidance only and are not a part of this agreement

References herein to a gender include both the others; and references to the singular include the plural and to a natural include a juristic person and vice versa in each case.
MY RESPONSIBILITY
My responsibilities are limited to making the booking in accordance with your instructions.

Booking Fee for Custom Tours: A standard, non-negotiable booking fee is invoiced when a client requests the Tour Operator to create a tailor-made tour and provide a pricing quote.

Booking Fee for Guided Tours: A standard, non-negotiable 30% booking fee and Guide Fee - is invoiced when a client requests the Tour Operator to create a tailor-made tour and provide a pricing quote.

I will not be responsible: -
-
where the arrangements cannot be provided or cannot be provided as described due to circumstances beyond my or any supplier’s control.
-
where you incur any loss or damage that relates to any business activity; or which could not have been foreseen at the time you made your booking in the light of the information you gave to me at the time of booking.

Except where otherwise expressly stated, I cannot accept liability or pay compensation where the performance of my obligations to you are affected or prevented as a result of ‘force majeure’. In these booking conditions, ‘force majeure’ means any event which either myself or the provider of the service in question could not foresee or avoid, even with due care and consideration. Such events include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside of my control.

ACCOMMODATION
ROOM TYPES

A "Double room" does not guarantee a double bed; a Double room means a room for 2 persons, furthermore, please note a room sold as "Twin Room" does not guarantee twin beds.

A "Triple room" means a room for 3 persons.
-
A "Quad room" means a room for 4 persons.
-
If you require either (1) Double bed in the room, or (2) single beds in a room, please REQUEST them at the time of booking.
BED LEVY / FEES / DEPOSITS / CONSERVATION TAX
-
Several Lodges / Hotels / Destinations now charge, bed levy / resort fees / tax. These amounts may vary and are charged by and payable by you to the Hotel / Destination you are travelling to. The Country or Hotel you are visiting reserve the right to change the amounts of these fees at any time and you must ensure you regularly check your Hotel / Destinations website for the most up to date charges as I am not liable for these charges.

Security / Key Deposits : Many of the lodges, self-catering / apartments & villas, require you to make a payment of a security deposit in cash in local currency or credit card upon arrival at your accommodation. These amounts may vary and will be collected upon your arrival.

Lodge / Tented / Hotel Facilities : Please read the description of the accommodation for policies applicable to your stay. Please note that the accommodation booked by me, for you are not exclusive to me. I am not responsible for any limitation in facilities because of other hotel guests or their activities. I do not take responsibility for hotel content (including images, facility listings, etc.) displayed on my website. Hotels may change facilities and property features without prior notice to me and it is the customers' responsibility to confirm facilities directly with the hotel at the time of travel.

Delays : On occasions there may be delays or missed departures, due to the failure of transportation or other circumstances. I cannot be held liable if the accommodation is not available on arrival. It is your responsibility to notify the hotel directly. Refunds will not be given for any no shows.

Building Work : Due to continuous re-development throughout the world there is always going to be some building work going on somewhere. Provided that I have been made made aware by the Property that any such work is liable to interfere with the enjoyment of your holiday, then I will advise you accordingly. However please be aware that the accommodation has no liability to inform me of any building work in the surrounding area outside their property.
TERMS and CONDITIONS of BOOKED ACCOMMODATION

All reservations must be received in writing by email.
-
All reservations are subject to availability, and if necessary, rooms will be put on a waiting list on a first come first serve basis.

All provisional reservations and requests are held for 7 days only and require a 30% non-refundable deposit to confirm the reservation, otherwise the booking will expire and be released from the reservation system.

Special dietary requirements to be emailed to my reservations department at least 30 days prior to arrival date.

The validity of the rates is subject to the time of booking.

Check-in and Check-out Times at Lodges
Check-in time is as from 14h00 on the day of arrival, and check-out is 10h00 on the day of departure.

A late check-out must be arranged, by you, the client, with prior approval of management of the lodges and is subject to the availability of rooms. Terms of Payment

Standard Booking Fees are applicable

A non-refundable deposit for Tour Accommodations amounting to 30% of the total value of the booking is payable within 7 days of confirming the reservation.
-
Full pre-payment to be received 90 days prior to travel.
-
If payment has not been received, I reserve the right to cancel the reservation and our cancellation policy will apply.
-
In the event where the reservation is made less than 30 days before arrival, such reservation must be paid immediately upon presentation of invoice.

Upon payment, a proof of payment (POP) with your name and booking reference number must be submitted to reservations (africa_liveit_loveit@yahoo.com)
ACCEPTANCE OF BOOKINGS - GENERAL TERMS
-
No contract between the Tour Operator and the Client shall come into existence unless and until the Tour Operator has received a signed booking form and a non-refundable deposit of 30% of the tour price and has issued to the Client or his travel agent a confirmation invoice.

The person signing the booking form shall be deemed (notwithstanding lack of actual authority, if this is applicable) to be signing on behalf of all persons listed in the form and is responsible to ensure that all such persons are aware of these conditions

A standard, non-negotiable booking fee is invoiced when a client requests the Tour Operator to create a tailor-made tour and provide a pricing quote.

The Tour Operator reserves the right to refuse to commence the rendition of any services contracted for unless the Client has signed a separate assent to these terms and, if the Client refuses to sign, to treat such refusal as a cancellation in terms, mutatis mutandis.

No variation (unless specially and specifically reduced to writing) of these conditions shall be of any force or effect, and no person other than an equity-holding member of the Tour Operator has authority to assent to such a variation.

These conditions and all other matters arising from the contract between the Client and the Tour Operator are governed and are to be interpreted according to the law of South Africa and subject to the exclusive jurisdiction of the South African courts.

Please read all booking conditions carefully as they set out our respective rights and obligations. In these Booking Conditions references to "you" and “your" include the first named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred.

By making a booking, the first named person on the booking agrees on behalf of all persons detailed on the booking that:

He she has read these terms and conditions and has the authority to and does agree to be bound by them.

He/she consents to our use of information in accordance with our Privacy Policy.
-
He/she is over 18 years of age and where placing an order for services with age restrictions declares that he/she and all members of the party are of the appropriate age to purchase those services.
BOOKING AND PAYMENT

A booking is made with a supplier when: -
-

you tell me that you would like to accept my written or verbal quotation.

you pay the deposit as required by the supplier of the arrangements in question (or full payment if booking within 12 weeks of departure)
-
you pay all applicable insurance premiums and booking fees; and
-
I send you a booking confirmation on behalf of the supplier.
-
Please ensure that names are exactly as stated in the relevant passport. As I act only as booking agent, I have no responsibility for any errors in any documentation except where an error is made by me. If you have paid a deposit, you must pay the full balance by the balance due date notified to you. If full payment is not received by the balance due date, I will notify the supplier who may cancel your booking and charge the cancellation fees set out in their booking conditions.
DEPOSIT REQUIREMENT AND NON-REFUNDABLE POLICY

Upon booking a guided tour, a non-refundable deposit equal to thirty percent (30%) of the total tour cost is required. This deposit includes the Standard Booking Fee and the Costs of the Tour Guide(s). The deposit must be paid at the time of booking to secure your reservation. By making this payment, you acknowledge and agree that the deposit is non-refundable under any circumstances.

PAYMENTS
-
To book a tour the Client must send a non-refundable deposit of 30% of the tour price with his booking form. The balance of the tour fare must be paid not later than 90 days before the tour departure date, otherwise the Tour Operator may treat the booking as cancelled and apply cancellation fees.
-
For groups (8 people or more) we require a 30% NON REFUNDABLE deposit to confirm the bookings with the balance 90 days prior to arrival.
-
If a tour is booked less than 60 days before the departure date, the Client must send the full tour price with his booking form.
-
Monies paid by the Client to a travel agent making the Client’s booking are held by that agent.

As agent for the Client until a confirmation invoice is issued by the Tour Operator

As agent for the Tour Operator and payable to the Tour Operator on demand
CANCELLATION POLICY/SELF DRIVE and GUIDED GROUPS
-
Only written cancellations/amendments will be accepted.
-
Kindly ensure that acknowledgments of cancellations/amendments are received by reservations.
-
A reservation will be considered amended/cancelled only once reconfirmed by reservations to the agent /client concerned.
-
Should a cancellation be received once a confirmed status is held, 30% of the total booking value will be charged.
-
SELF DRIVE: Cancellation within 90 to 31 days prior to date of travel will incur a 50% of total booking value.
-
GUIDED: Cancellation within 90 to 31 days prior to date of travel will incur a 50% cancellation fee of the remaining 70%
-
SELF DRIVE: Cancellation within 30 to 15 days prior to date of travel will incur a 75% cancellation fee.
-
GUIDED: Cancellation under 30 days prior to date of travel will incur a 100% cancellation fee.
-
ADDITIONAL: Refunds are also subject to the Terms and Conditions of the Establishments booked.

No refunds will be made for no shows or any unused services due to flight delays, strikes or anything else beyond the control of the Tour Operator
REMAINING PAYMENT AND ALLOCATION OF FUNDS
-
The remaining seventy percent (70%) of the total tour cost is assessed 90 days before departure and is payable no later than eight weeks before the tour commencement.
-
This remaining balance will be used to cover the entire tour bookings, including but not limited to, accommodations, transportation, activities, meals, and any other services specified in the tour itinerary. Additionally, this amount covers the participant's share of the costs for the Tour Guide(s). By proceeding with the payment, you acknowledge and agree that the allocation of these funds is for the comprehensive execution of the tour as detailed in the tour agreement.
ACCURACY

I endeavour to ensure that all the information and prices both on my website and in my brochures are accurate, however occasionally changes and errors occur, and I reserve the right to correct prices and other details in such circumstances. You must check the current price and all other details relating to the arrangements that you wish to book before your booking is confirmed.
INSURANCE
-
Adequate travel insurance is vital. If you choose to partake in arrangements without adequate insurance cover, we will not be liable for any losses howsoever arising, in respect of which insurance cover would otherwise have been available.

It is strongly recommended that travel insurance be taken out to cover against such charges
-
Once the tour has started, no refunds will be made under any circumstances for any unused sector. If the Tour Operator has to cancel a tour, the Client will be offered the choice of an alternative tour if available.
ALTERATIONS TO PRICE AND SERVICES

The prices, services and itineraries in the brochure are correct at the time of publication but may be altered. Any such alteration will be notified to the Client before a booking is confirmed.

The Tour Operator may make minor changes to any tour without any right of compensation to the Client. Major changes such as, without limitation, major alterations of itinerary, overnight stops, destination or timing, may be effected by the Tour Operator at its discretion for reasons of safety, convenience, a force majeure event, accident or breakdown.
JURISDICTION AND APPLICABLE LAW
CHANGES BY YOU

If you wish to change any part of your confirmed arrangements, you must inform me in writing as soon as possible.
-
This should be done by the first named person on the booking.
-
Whilst I will do my best to assist, I cannot guarantee that the supplier will be able to meet your requested change as amendments can only be accepted in accordance with the terms and conditions of the supplier. The supplier may charge the amendment charges shown in their booking conditions (which may be as much as 100% of the cost of the arrangements and will normally increase closer to the date of departure).

In addition, you must pay an administration fee.
Note: Certain arrangements may not be amended after they have been confirmed and any alteration could incur a cancellation charge of up to 100% of that part of the arrangements.
NO SHOW
-
If you have a booking for any of our products or services, including flights, car hire, accommodation and packages, but you do not show up to check-in, collect the car or otherwise do not avail yourself of such product or service, you will not be entitled to any refund from us. Certain airlines may also cancel the return portion of your ticket if you fail to take the outbound journey.
BY OPERATOR

The operator reserves the right to make minor changes to the itinerary if necessary, such as due to weather conditions or other unforeseen circumstances. Significant changes will be communicated to the client as soon as possible.
LIABILITY
-
Africa Live It Love It, cannot be held liable for any injury, loss of life or damage of any valuables.
-
Guests will usually be asked to sign an indemnity form on Tour Arrival and at the respective lodges.
LIMITATION OF LIABILITY
-
The Tour Operator is liable only for losses, damage and personal injury suffered or sustained by the Client in the course of services provided by the Tour Operator in the course of a tour and caused by or attributable to the Tour Operator, which services do not include the provision of accommodation, sightseeing tours and other services of any nature provided by third parties, which said third parties are independent of the Tour Operator.

IN securing for the Client bookings for services provided by such third parties the tour Operator takes no undertaking nor gives any warranty as to the provision of any services or goods, accepts no liability for any failure to provide the same, and does not indemnify the Client against any loss, damage or injury caused by or attributable to such third parties.

In no circumstances will the Tour Operator be liable for any consequential damages, or to any extent beyond the cost of a tour, because of cancellation of major alteration of that tour, even if such cancellation or alteration occurs by reason of fault of or attributable to the Tour Operator.
CHANGES TO TERMS AND CONDITIONS

I may amend these terms and conditions at any time without prior notice. If I do amend these terms and conditions, the amended terms will be effective when posted on my website and you are deemed to have accepted the relevant changes.
ADDITIONAL TERMS AND CONDITIONS

Additional terms and conditions may apply to reservations, purchases of goods and services and other uses of portions of this site, and you agree to abide by such other terms and conditions.

Many of the services which make up your holiday are provided by independent suppliers. Those suppliers provide these services in accordance with their own terms and conditions Those suppliers provide these services in accordance with their own terms and conditions which will form part of your contract with me. Some of these terms and conditions may limit or exclude the supplier's liability to you, usually in accordance with applicable International Conventions. Copies of the relevant parts of these terms and conditions are available on request from the supplier concerned.

Excursions : Excursions or other tours that you may choose to book or pay for whilst you are on holiday are not part of your contracted arrangements with me. For any excursion or other tour that you book, your contract will be with the operator of the excursion or tour and not with me. I am not responsible for the provision of the excursion or tour or for anything that happens during the course of its provision by the operator.
YOUR BEHAVIOUR

It is your responsibility to ensure that you and the members of your group do not behave in a way which is inappropriate or causes danger, distress, offence or damage to others or which risks damage to property belonging to others (including but not limited to drunkenness and air rage) whilst on your trip.
COMPLAINTS
-
I make every effort to ensure that your holiday arrangements run smoothly but if you do have a problem during your holiday, please inform the relevant supplier (e.g., your hotelier) immediately who will endeavour to put things right.
WEATHER
-
I cannot be held responsible for any disruption to your trip due to bad or unusual weather conditions.
FOREIGN OFFICE ADVICE
-
You are responsible for making yourself aware of Foreign Office advice and State Department warnings regarding the safety of the countries and areas in which you will be travelling and to make your decisions accordingly. This is not my responsibility.
Having read the above booking conditions and on signing the booking consent form and by making payment, you agree and accept the above Terms and Conditions on behalf of all members of your party by whom you are duly authorised to make this agreement
